Publication of new law that extinguishes 1716 careers and categories of PA

The decree-law 121/2008, of 11 July, identifies and extinguishes 1716 careers and categories of Public administration establishing the transition of staff to the new general career system.

One fundamental principle of the current Public Administration (PA) reform was to reduce the number of existing careers. Special regime careers will only remain when specific functional duties and content, as well as training or academic basic qualifications, clearly justify it.

The existence of a diversity of general regime careers, with several designations and often inadequate to Public Administration necessities, shows the need to integrate them in the new general regime careers.

This merger does not mean the disappearance of the existing posts and professions specificities. These specificities will be integrated in their characterisation in each establishment plan of each public body or service.

With the current law 1716 careers and categories were extinguished. Transition made by said legal text comprises the holders of careers and categories of direct and indirect state administration, regional and local administrations and other state bodies. 

Nevertheless, a number of situations will remain,being defined specific rules regarding their placement in the salary scale. The option right to integrate those remaining situations into the new careers is foreseen.

A wide set of legal texts and rules on the careers and categories now under the process of extinction were identified with the objective to make clear and unequivocal its non maintenance in the juridical order.
