MOBILITY – FRAMEWORK

» Concept

Mobility is deemed as the legal mechanism that allows for the public employee to temporarily perform the same or different functions within the same service, or between different bodies or services without the need for a recruitment procedure. It is grounded on public interest, with a view to increasing the services efficiency and effectiveness by way of a rational use and valorisation of Public Administration human resources

» Application Scope

Mobility applies to all public employees with a permanent public employment relationship performing their functional duties in a service covered by the General Labour Law in public functions scope

» Presuppositions

» When there is public interest, namely for resason of the bodies and services economy, efcacity and efficiency

» Needs dully justification

» Appropriate qualifications are required for cross-category and cross-career mobility and the change in the original pay step may not be substantial

It may occur within

» The same service or between two bodies or diferent services

» The same public employment relationship form for indetermined period of time or among both modes

It is apllied without distinction to:

» Active public employees, performing functions on a full time or partial time basis

» Public employees under a requalification situation

» Mobility modalities – within the same category, cross-categories or cross-careers

Mobility within the same category

» Within the same activity

» To different activity if holding the adequate academic qualifications

» To a higher category

» To a lower category

Cross-careers mobility

» To a career with equal complexity degree

» To a career with higher complexity degree

» To a career with lower complexity degree

Limitation

Persisting careers/categories

There shall not be mobility for persisting careers, with the exception of public employees already holders of the respective category
