» Concept

Non subjection to work schedule is translated in the performance of work not subject to the compliance with any of the patterns of work schedule provided for in the General Labour Law in Public Functions nor to the observance of the general duty of assiduity and of compliance with work weekly duration, but it does not release the regular contact of the public employee with the service

» Regime

It depends upon express agreement of the worker in relation to tasks and time limits of its carrying out

It implies the setting of a fixed time limit for the carrying out of the task to be performed, that shall not exceed the maximum limit of 10 working days

In the regime of non subjection to work schedule is conceivable the materialization, even though embryonic, of the telework regime

The management staff enjoys release from work schedule, as well as, staff whose functions do not confer the right to extraordinary work
