TIME CREDIT AND ABSENCES OF THE TRADE UNION ASSOCIATION BOARD MEMBERS

» Time credit

Concept and scope

The time credits have nature similar to the release from service regime translated in the "right to a credit of not working"

The members of the trade union association board benefit from time credit corresponding to four days’ work per month that may use in half-day periods

Regime

» There is no place for the accumulation of time credit by the fact that the public employee belongs to more than one structure of public employees’ collective representation

» Time credit is deemed as actual service for all legal purposes, including those related to the compensation

» Trade union association shall communicate, by 15 January of each calendar year, to the Directorate General for Administration and Public Employment, as well as to the body or service in which fulfil functions, the identification of members who benefit from time credit

» Trade union association shall still communicate, with one day in advance or, in the case of impossibility, in the two immediate working days the dates and the number of days that the members need for the fulfilment of the respective functions

» Justified absences

Concept and scope

The members of the board beneficiaries of time credits are still entitled to justified absences, without limit, that are taken into account for all legal purposes as actual service, save as to the compensation

The other board members who do not enjoy the time credits are entitled to justified absences until the limit of 33 days per year that are taken into consideration for all legal purposes as actual service, save as to the compensation

Regime

The absences are only deemed justified provided that they are communicated in writing, with one day in advance, or, in the case of impossibility in the 48 hours immediate to the first day of absence

Whenever the number of absences is extended beyond one month the contract is suspended due to a fact relating to the public employee, except when the absence is determined by the accumulation of time credits by board members
