SUSPENSION AND TERMINATION OF BENEFITS
Convergent Social Protection Scheme/Social Security General Scheme

» The grant of the initial parental allowance is suspended during the illness, with or without hospitalisation, of the progenitor who shall be enjoying the leave or during the hospitalisation of the child, provided that the beneficiary communicates the suspension of the enjoyment of the leave, after its confirmation by the employer entity, and submits medical certification of the situation

» The grant of allowances of clinic risk during the pregnancy, pregnancy termination, initial parental exclusive of the mother, initial parental of a progenitor in the case of impossibility of the other one, initial parental exclusive of the father, for adoption, extended parental and for assistance to a son/daughter with disability or chronic disease is suspended during the illness with or without hospitalisation, of the progenitor who is enjoying the respective leave, provided that the beneficiary communicates the suspension of the leave’s enjoyment, after its confirmation by the employer entity, and submits medical certification of the situation

» During the periods of suspension previously referred to, the beneficiary is entitled to benefits of protection in the illness, compensation or allowance, according to social protection scheme in which is framed, or for assistance to a son/daughter, in the case of hospitalisation of the child, if he/she maintains to be absent to the work for assistance to a son/daughter

» The right to allowances ceases when terminates the causes that originated them

» The right to allowances still terminates when the resumption of activity takes place, irrespective of the evidence of existence of compensation

» Articulation with protection in the unemployment

The beneficiaries who are receiving benefits of protection in the unemployment are entitled to the grant of allowances of clinic risk during the pregnancy, for interruption of pregnancy, initial parental exclusive of the mother, initial parental and for adoption, provided that the corresponding situations are verified, being suspended the payment of those benefits during the period of grant of these

» Non cumulative with work incomes and with social benefits

The benefits are not accumulable:

- With the payment by employer entities of compensations or other regular cash benefits without the corresponding performance of effective and actual work

- With social benefits substitutive of work income lost, except the disability, old age and survivor’s pensions, as well as the compensatory pensions due to permanent incapacity or death resulting from accident at work or occupational disease

- With social benefits of the solidarity subsystem, except the insertion social complement and the solidarity complement for older people
