EXEMPTION FROM WORK SCHEDULE

» Concept

The exemption of work schedule is translated in the:

» Non subjection to maximum limits of normal periods of work (that is to say, 8 hours per day and 40 hours per week)

» Possibility of extension of the performance to a determined number of hours, per day or per week, this extension shall not, as a rule, be higher than two hours per day or ten per week

» Observance of the normal periods of work agreed

» Scope

Management positions and other public employees who head multidisciplinary teams (in the form of non subjection to the maximum limits of the normal periods of work, workers holders of management positions and who head multidisciplinary teams)

Other public employees provided that the possibility of exemption from work schedule is admitted by law (for example. laws governing special careers) or by collective labour regulation instrument

» Regime

In default of law, collective labour regulation instrument or stipulation of the parties, the regime of exemption from work schedule follows the pattern of extension of the performance of work to a determined number of hours, per day or per week; this extension shall not be higher than two hours per day or ten hours per week

Compensation supplement

Public employees who enjoy exemption from work schedule in the patterns of non subjection to the maximum limits of the normal periods of work and possibility of extension of the performance to a determined number of hours, are entitled to a compensation supplement, under the terms that are set by law or by collective labour regulation instrument, provided that the regime of exemption from work schedule does not constitute the normal regime of performance of work of the career in which the public employee is integrated or of the position of which is holder (in these cases, the exemption of work schedule shall have been taken into consideration for the determination of the respective basic compensation)

Therefore, public employees’ holders of management positions and heads of multidisciplinary teams are not entitled to a compensation supplement
