RELEASE FROM PERFORMANCE OF WORK BY PREGNANT PUBLIC EMPLOYEE, THAT WHO HAS RECENTLY GIVEN BIRTH OR IS BREASTFEEDING, FOR REASON OF PROTECTION OF HER SAFETY OR HEALTH

» Concept

Release from performing service by pregnant public employee, that who has recently given birth or is breastfeeding, with a view to avoiding risk exposure for her safety and health at workplace

» Scope

Pregnant public employee, that who has recently given birth or is breastfeeding who fulfils activity liable to present a specific risk of exposure to agents, processes or working conditions that may cause risk for her safety and health and would have an impact on the pregnancy or breastfeeding

» Regime

» The public employer shall assess the nature, degree and duration of exposure to risks and take the necessary measures to avoid it

» If the adaptation of working conditions proves to be impossible, extremely time-consuming or expensive other tasks compatible with the public employee’s state shall be assigned

» If the prior measures do not reveal to be feasible the public employee shall be released from performing work during the necessary period of time
