CHANGE OF PAY STEP

The career advancement of public employees is made, as a rule, by change of pay step for the pay step immediately following that one in which the public employee was placed

Nota: Paragraph 4 of article 82 of the General Labour Law in Public Functions establishes that all public employees are entitled to full career advancement, materialized in the change of pay step or by promotion, the latter is applicable to the Armed Forces personnel along with the police force of a military nature (Guarda Nacional Republicana)

Requirements

» Obtaining in the last performance assessment relating to the functions fulfilled during the pay step of:

- One maximum rating

- Two consecutive ratings immediately lower than the maximum; or

- Three consecutive ratings immediately lower than those referred to in the preceding point, provided that they consubstantiate positive performance

» Integration of public employees in the universe of careers and categories where changes of pay step may take place

» Budget estimate to the maximum amount of charges set for changes of pay steps, previously defined

The universe of careers and categories may be disaggregated, whenever the top manager so judges according to:

» Assignment, competence or activity that public employees integrated in a determined career or holders of a determined category must comply with or perform

» Academic or professional training area of public employees integrated in a determined career or holders of a specified category, when such training area has been used in the characterization of work posts included in workforce lists

» Compulsory change

It takes place when the public employee has accumulated 10 points in his/her performance assessments referred to the functions fulfilled during the pay positioning in which is placed, counted under the following terms:

» Six points for each maximum rating

» Four points for each rating immediately lower than the maximum one

» Two points for each rating immediately lower than that one referred to in the preceding item, provided that it consubstantiates positive performance

» Two negative points for each rating corresponding to the lowest level of assessment

» Change of pay step special rules

When demanded ratings are not met

The change of pay step is made for the pay step immediately following to that one in which the public employee is inserted, provided that such public employee has reached as last performance assessment the maximum rating or that one immediately lower and is included in the previously defined universes for change of pay step by management decision

When demanded ratings are met

The change of pay step is made, meeting the legally demanded ratings, for any other pay step following that one in which the public employee is inserted, having as a limit the maximum pay step for which have changed their pay step public employees who, within the scope of the same universe are superiorly ordered

Note

» When exceptional changes of the pay step are in question, subjected to special rules as defined by law, the top manager of the service is obliged to hear the Assessment Coordinating Council (CCA), or the body with equivalent competence

» Exceptional changes of pay step shall be particularly justified and made public, with full and complete content of the respective justification and of the opinion of the Assessment Coordinating Council, or the body with equivalent competence, by way of publication in the 2nd Series of the Official Gazette, and by affixing in the service and by insertion on the electronic page

» Effects

In the absence of special law to the contrary, the change of pay step is reported to 1st January of the year in which it takes place
