SUPPLEMENTARY WORK

» Concept

Supplementary work is that which is performed outside the work schedule, including the work performed in compulsory or complementary weekly rest days and public holidays

Note

Supplementary work may take place in cases of exemption from work schedule, when this exemption has been limited to a determined number of daily or weekly work hours

» Regime

The public employee is obliged to perform extraordinary work, existing, however, situations in which he/she has the right to be released from the respective performance, as it is the case of pregnant public employees, parents with children with age lower than 12 months, in cases provided for in the law, student workers, disabled persons or holders of a chronic disease

Limits

The performance of supplementary work is subject to the following limits:

» 150 hours per year, that may be increased up to 200 hours per year, by collective labour regulation instrument

» 2 per work normal day

» A number of hours equal to the work normal period, in compulsory or complementary weekly rest days and public holidays

Elimination of limits

The limits referred to may be overcome provided that:

» They do not imply compensation for supplementary work higher than 60% of the basic compensation of the worker, when it deals with drivers, operators or other workers integrated in the general careers of administrative staff or technical support staff

» Under exceptional and delimited circumstances in the time, by means of authorisation of the competent member of the Government (supervision) or, when this one shall not be possible, by way of confirmation of the same entity, to be delivered on the 15 days following the occurrence

Compensatory rest

Once the performance of supplementary work takes place on a compulsory weekly rest day the public employee is entitled to a remunerated compensatory rest day to be enjoyed in one of the 3 following working days
