RELEASE FROM PERFORMANCE OF NIGHT WORK

» Concept

Release from performing service between 8pm of a day and the 7am of the following day

» Scope

Pregnant public employee, or who has recently given birth or breastfeeding:

» During a 112 day period before and after the childbirth, of which, at least, half before the predictable date of it

» During the remaining pregnancy period, where necessary for her health or for that of the unborn child

» During all the time that lasts the breastfeeding, where necessary for her health or for that of the child

» Regime

Only benefits from release from performance of night work if she cannot perform the work in a compatible daytime schedule

» Formalities

» The public employee who intends to be released from performing night work shall inform the employer within ten day in advance and, in the following cases, submit medical certificate:

» If she needs to enjoy the release in a period prior to 112 days before the childbirth

» If she needs to enjoy the release during the breastfeeding period

Note

The information to the public employer shall not depend upon time limit of prior notice under urgency situation proven by the physician

» It does not determine the loss of any rights whatsoever, but

» Loss of pay
