TIME CREDIT AND ABSENCES OF TRADE UNION REPRESENTATIVES

» Concept

They are public employees elected to carry out trade union activity inside the body or service, for the fulfilment of their functions the following rights are provided for in the law

» Time credit

Regime

Each trade union representative has a twelve hour credit per month that is deemed as actual length of service

Formalities

In order to fulfil the right to time credit, the public employer should be informed, in writing, within a minimum two day in advance, save relevant reason to be taken into account

» Absences

Regime

Each trade union representative may justifiably be absent to the service, beyond the time of absence granted under the time credit, provided that the absence is justified for the practice of necessary and pressing acts for the fulfilment of their functions; such absence is deemed for all legal purposes as actual service, save as to the compensation

Formalities

The absences are only deemed justified provided that they are communicated in writing, within one day in advance or, in the case of impossibility, within the 48 hours immediate to the first day of absence
