FINAL REPORT PHASE

» Summary

Phase in which the examining officer shall draw up a concise and comprehensive report that describes all legal steps carried out, assesses the facts and circumstances and puts forward acquittal, enforcement of a disciplinary penalty or filing of the procedure

» Drawing up of the report

» Time limit: 5 days extendable until the total of 20 days

» Content: summary of facts and their weighting, qualification and seriousness, and submission of a concrete proposal of possible penalties, acquittal or filing

» Addressee: entity that has instituted the procedure that decides it, if has competence, or resends for whichever has competence to decide

» When the enforcement of a compulsory early retirement or dismissal is proposed, the report is also sent, save objection raised by the accused, to the public employees committee and trade union association if the accused is their representative
