Justified absence of the public employee waiting to be assigned to functions compatible with his/her state of health

» The public employee deemed by a medical board, unable to fulfil his/her functions, but able for others for which may not be assigned by internal mobility

» Absences are deemed justified from the declaration of incapacity until the resumption of functions

» Obligations

During the situation of absences for professional rehabilitation the public employee must apply for all job posts for which he/she meets the requirements

» Rights

The obligation to apply for has limits, when it deals with assignment in a district council different from that of his/her residence or of the service of origin or of the neighbouring district councils of Lisbon and Porto, when in one of these district councils the service of origin or the residence are located; in this case the public employee may invoke and prove that such assignment causes a serious damage to his/her personal life
