INITIAL PARENTAL LEAVE

» Concept

Justified absence from work on the occasion of birth of a child to be enjoyed by the mother and/or by the father public employees

» Regime

» Variable duration between 120 and 150 consecutive days, that may be enjoyed by the mother and father

» If there is a sharing of the enjoyment of the leave, in which each progenitor enjoys, exclusively, 30 days or two periods of 15 days, consecutive in both cases, 30 days may be added to those periods

» The right to the added periods depends upon joint declaration of the working parents to the respective public employers, within the time limit of 7 days after the birth, by informing on the choice of the sharing, total duration chosen and indicating the periods to be enjoyed by each progenitor

» In the case of multiple births, 30 days for each twin besides the first one are added to total periods of the leave duration

» Possibility of suspension of the leave in the case of hospitalization of the child or of the progenitor who is enjoying the leave

» Formalities

» Declaration of the other progenitor stating that the same fulfils professional activity and that does not enjoy the initial parental leave

» Communication of the suspension of the leave in the case of hospitalization of the child or of the progenitor who is enjoying the leave, accompanied by a declaration issued by the hospital establishment

» Communication within the time limit of 5 days on the termination of the situation that gave rise to the respective leave
