COMMON PROCEDURE

It is applied when there is no room for a special procedure

» Competence for the initiation:

» Any hierarchical superior against the respective subordinates

» Member of the Government against top managers

» Nature:

» The procedure is secret until the charge is brought

» The procedure may be made available to the accused, provided that the respective content shall not be disclosed

» Certificates may be extracted from the procedure for the defence of legally protected interests, however their disclosure shall be prohibited

» Appointment of a lawyer:

» A lawyer may be appointed, at any time

» The lawyer shall enjoy all rights recognized to the accused

» Common procedure phases:

» Examination phase

» Accused’s defence phase

» Final report phase

» Decision phase
