LEAVE UNDER A CLINICAL RISK SITUATION DURING PREGNANCY

» Concept

Justified absence from work for the period of time that, for medical prescription, is deemed necessary to prevent the risk for the pregnant public employee or for the unborn child, deterrent factor for the fulfilment of functions

» Scope

Pregnant public employee under a clinical risk situation for herself or for the unborn child

» Regime

The public employee is entitled to a leave for the period medically indicated whenever:

» The clinical situation declared renders deterrent the fulfilment of the activity, or

» Provided that the public employer does not change the conditions of such fulfilment, in accordance with medical prescription

» Formalities

» Information to the public employer, with 10 days in advance, or, in the case of urgency, proven by the physician, at the earliest convenience

» Submission of a medical certificate attesting the clinical risk situation, conditions of fulfilment of activity, where appropriate, or the predictable duration of the leave

» Effects

» Loss of pay, whenever there is not fulfilment of activity

» Suspends the enjoyment of holidays, and the remaining days must be enjoyed after its term, even if such fact occurs in the subsequent year

» Does not affect the time already elapsed of internship or of training and the public employee shall comply with only the missing period to complete it

» Postpones the carrying out of tests, whenever necessary for the professional career development

» Right to resume activity at the term of the leave
