IMPEDIMENTS REGIME

» Concept

Impediments are the circumstances that prevent a public employee from intervening in an administrative procedure:

» When the public employee, spouse or relative or related in the direct line or up to the 2nd degree of the collateral line has direct interest, or through an intermediary person, in that procedure or in a similar procedure

» When any of the same have intervened in the procedure as an expert or attorney

» When it deals with an appeal of the decision taken by any of the same

» When there is a legal action against the public employee, the spouse or relative or related in the direct line, brought by the holder of the procedure

» Legal procedures/steps

» Immediate communication to the hierarchical superior

» Immediate suspension of the intervention in the procedure

» Adoption of undelayable measures in case of urgency or of danger, subject to ratification

» Effects

Replacement of the impeded public employee
