Death allowance

The allowance is equal to three times the gross value of the last compensation, that constitutes the contribution base for the Public Employee General Pension Scheme - CGA, or of the last pension, having as a maximum limit three times the value of the Social Support Indexation (SSI) value –in 2013 - 419,22€

Survivor’s pension

1 – Due to subscriber’s or retiree’s death occurred until 31.12.2005 or after this date, if the deceased were retiree based on the retirement scheme in force until 31.12.2005:

50% of the retirement pension or of that one which would have entitled on the death’s date, global amount to be divided by different pension’s rightholders

Example

For a public employee’s death to whom a spouse and 3 minor children have survived, the survivor’s pension corresponds to 50% of the retirement pension that the deceased public employee would be entitled, if he/she were retired on that date, and this global value shall be divided by four rightholders, half of the said value shall be destined to the spouse and the other half shall be divided by the 3 children, 16,66% for each one

2 – For subscriber’s or retired person’s death occurred after 1.1.2006, if the deceased was retiree as as from 1.1.2006, based on the calculation formula composed of two parts (P1 e P2)

Variable percentages of the retirement pension or of that one he/she would have right on the death’s date, are to apply according to rightholders:

- spouse and former spouse - 60% or 70%, according to 1 or more than 1 survive

- descendants: 20%, 30% or 40%, according to 1, 2 or more than 2 survive, if there are spouse or former spouse entitled to the pension. Otherwise, 40%, 60% and 80% according to 1, 2 or more than 2 survive

- ascendants: 30%, 50% or 80%, according to 1, 2 or 3 or more survive who meet the legal requirements

Example

For a public employee’s death to whom the spouse and 3 minor children have survived, the mother is entitled to 60% of the 2nd retirement pension’s part (P2) that the decesased public employee would have right, if he/she were retired on that date, and the 3 children have the right to a 2nd pension, that is added to that of the surviving spouse, corresponding to 40% of the same part (P2), divided by 3, and 13,33% it is up to each one. If one of the children no longer meets the requirements, the other 2 shall have a pension corresponding to 30% of the same part (P2), divided for each one, but the surviving spouse shall mainatain the respective pension

3 – For subscriber’s or retireee’s as from death occurred after 1.1.2006 and affiliated to the Public Employee General Pension Scheme - CGA after 1.9.1993

Variable percentages of the retirement pension or of that he/she would have right on the death’s date, according to the rightholders:

- spouse and former spouse - 60% or 70%, according to 1 or more than 1 survive

- descendants : 20%, 30% or 40%, according to 1, 2 or more than 2 survive, if there are spouse or former spouse entitled to the pension. Otherwise, 40%, 60% and 80% according to 1, 2 or more than 2 survive

Example

For public employee’s death to whom the spouse and 3 minor children survived,the surviving spouse is entitled to 60% of the retirement pension that the deceased public employee would have right, if he/she were retired on that date and the 3 children are entitled to a 2nd pension, that is summed to the surviving spouse correspondoing to 40% of the same pension, divided by 3, 13,33% shall be incumbent upon each one. If, one of the children no longer meets the requirements, the other 2 shall have a pension corresponding to 30% of the retirement pension, divided by each one, but the surviving spouse shall maintain the respective pension

Death’s allowance

The allowance shall be requested to services where the deceased public employee fulfiled functions or the Public Employee General Pension Scheme, in the case of the retiree’s death, within the deadline of 1 year calculated as from the death’s date or of the disappearance

Survivor’s pension

The pension shall be requested to the Public Employee General Pension Scheme within the time limit of 12months after the death’s date, case in which the pension is due since the month following to this date , or without limit, in this case the pension shall be due as from the month following to that of the request’s delivery
