Circumstances that allow for reasonable suspicion in relation to the public employee?s neutrality:

» When there is interest of relative or related in the direct line or up to the 3rd degree of the collateral line

» When the public employee, spouse or relative or related in the direct line shall be creditor or debtor of the holder of the procedure

» When there have been receiving of donations

» When there is serious animosity or great intimacy between the public employee and the holder of the procedure

» Legal steps

» The public employee requests the release or the holder of procedure gives rise to suspicion

» The public employee suspends immediately its intervention in the procedure

» In case of urgency or of danger, the public employee adopts undelayable measures, subject to ratification

» The hierarchical superior hears the public employee
