INVALIDITY AND OLD-AGE
Objective, protection and conditions to grant the pension
(Convergent Social Protection Scheme)

» Objective and materialization of the protection in the invalidity and old-age

Ensuring a substitutive benefit of the lost work income, when the beneficiary is under a situation of:

- Permanent incapacity for the fulfillment of his/hers functions or of any work, for non-professional cause - invalidity

- When reaches the age legally presumed as appropriate for terminating the professional activity - old-age

» It is materialized through the lifetime grant of the retirement pension, paid by the Public Employee General Pension Scheme - (CGA)

» Conditions to grant the retirement pension

Common to invalidity and old-age

» Affiliation to CGA

» Payment of contributions or equivalent situation to the entry of contributions

» Compliance with a minimum period of work

» in the case of absolute or general absolute incapacity (invalidity), of 5 or 3 years, respectively

» in the case of old-age:

- of 15 consecutive or interpolated calendar years

Calculation of the length of service

» Retirement Statute rule - 1 year (not calendar year) corresponds to12 months of fulfilment of functions (payment of contributions) or equivalent situation

» Social Security General Scheme rule - 1 calendar year provided that there are, at least, 120 days with compensation registration or equivalent situation – number of contributions paid in each calendar year

» The minimum period of work may be completed by recourse to the total contribution periods for social security institutions, provided that they are not overlapped

» Conditions to grant the retirement pension

Specific of invalidity

» Absolute invalidity – certification by the CGA Medical Committee, of the permanent and absolute incapacity for the fulfillment of the beneficiary’s function

» General absolute invalidity – certification by the CGA Medical Committee, of permanent and absolute incapacity for a profession or work of any kind whatsoever

Specific of the old-age

» Equal age to 66 years, in 2016
