SETTING OF THE PAY SCALE

» Regime

Public employees under an employment contract regime

» When a workplace is in question in relation to which the pattern of the public employment legal relationship is the contract, the positioning of the recruited public employee in one of the pay scales of the category shall be the subject of negotiation with the public employer entity

» The negotiation between the public employer entity and each one of the applicants, as per the final ordering, is carried out in writing

» In exceptional cases, duly grounded, namely when the number of applicants is in such a way high that the negotiation becames unfeasible, the public employer entity may take the initiative of materialising it in an adhesion proposal to a determined pay scale forwarded to all applicants

» Lack of agreement with an applicant leads to the negotiation with the one who follows him/her in the final ordering, to which, in any case, a higher pay scale to the maximum that has been proposed and not accepted by any of the applicants who have preceded him/her in that ordering may not be put forward

Public employees under an appointment regime

» When a workplace is in question in relation to which the pattern of the public employment legal relationship is the appointment, special law may make it applicable the regime defined for public employees under an employment contract regime
