When the termination of the tenure results from the extinction or reorganisation of the organic unit or stems from the need to give new orientation to the services management, and provided that managers have, for at least 12 months of fulfilment of functions, they are entitled to an indemnity calculated according to the length of service missed for the termination of the tenure and to the amount arising from the difference between the basic compensation of the outgoing management position and the compensation of the respective category/function of origin.

However, the indemnity amount has as a maximum limit the value corresponding to the annual difference of compensations, in which the Holidays and Christmas allowances are included.

The right to indemnity is recognized only in cases where the tenure is not  immediately followed by the new fulfilment of management functions in a position at an equal or higher level, or fulfilment of another public position with an equal or higher compensation level.
